Terms and Conditions

1) Usage of Momentra

  • The Momentra Platform (including any mobile applications, websites, and web-based platforms) is provided by Momentra Knowledge Trade Pvt. Ltd. (“Momentra”). Through the Momentra Platform, any individual with a verified account
    (“User”) can access and participate in the services offered on the platform.
  • A User accessing the Momentra Platform shall be bound by these Terms and Conditions, as well as all other rules, regulations, and terms of use referenced herein or provided by Momentra in relation to any services offered through theMomentra Platform (“Momentra Services”). Momentra shall be entitled to modify these Terms and Conditions, rules, regulations, and terms of use referred to herein or provided by Momentra in relation to any Momentra Services, at any
    time, by posting the same on the Momentra
    Platform. Use of the Momentra Platform constitutes the User’s acceptance of such Terms and Conditions, rules, regulations, and terms of use, as may be amended from time to time.
  • Momentra may, at its sole discretion, also notify the User of any change or modification to these Terms and Conditions, rules, regulations, or terms of use by sending an email to the User’s registered email address or by posting anotification in the User’s account. The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms and Conditions, rules, regulations, and terms of use. If the Userdoes not exercise such options within the time frame prescribed, the User will be deemed to have accepted the modifications.
  • Certain Momentra Services provided on the Momentra Platform may be subject to additional rules and regulations specific to those services. To the extent that these Terms and Conditions are inconsistent with such additional
    conditions, the additional conditions shall prevail.
  • Momentra may, at its sole and absolute discretion.
    • Restrict, suspend, or terminate any User’s access to all or any part of the Momentra Platform or Momentra Services
    • Change, suspend, or discontinue all or any part of the Momentra Services
    • Reject, move, or remove any material submitted by a User
    • Move or remove any content available on the Momentra Platform
    • Deactivate or delete a User’s account, along with all related information and files associated with that account
    • Establish general practices and limits concerning use of the Momentra Platform
    • Offer discounts or cash rewards to Users in a form it deems appropriate (“Cash Bonus”)
    • Revise, add, or remove questions, data, or information related to any specific outcome being bid on
    • Assign its rights and liabilities under all User accounts to another entity (such assignment will be communicated to all Users via their registered email addresses)
  • In the event any User breaches, or Momentra reasonably believes that such User has breached these Terms and Conditions, or has illegally or improperly used the Momentra Platform or the Momentra Services, Momentra may, at its sole
    and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User’s access to all or any part of the Momentra Platform, deactivate or delete the User’s account and all related information on the
    account, delete any content posted by the User on Momentra and further, take technical and legal steps as it deems necessary.
  • If Momentra charges its Users a platform fee in respect of any Momentra Services, Momentra shall, without delay, refund such platform fee in the event of suspension or removal of the User’s account or Momentra Services due to any
    negligence or deficiency on the part of Momentra. However, no refund shall be made if such suspension or removal is due to:
    • any breach or inadequate performance by the User of these Terms and Conditions, or
    • any circumstances beyond the reasonable control of Momentra.
  • By accepting these Terms and Conditions, Users consent to receiving communications such as announcements, administrative messages, and advertisements from Momentra or any of its partners, licensors, or associates.
  • Any User who is “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, undischarged insolvents, etc., is not eligible to enter into this Agreement with Momentra. For the purpose of Momentra Services offered by Momentra, an “Agreement” shall mean these Terms and Conditions, the Privacy Policy, and any other rules or policies available on the Momentra Platform, including all additional or modified terms and conditions and policies related to the Momentra Platform or any current or future services offered by Momentra. This Agreement is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011. This Agreement is an electronic record generated by a computer system and does not require any physical or digital signatures.
    Certain services provided by Momentra may be subject to additional conditions or rules applicable to those specific services (“Game Terms”). Such Game Terms are deemed to be incorporated herein by reference. Users must agree to these Game Terms before participating in any such game or contest on the Momentra Platform. To the extent that these Terms and Conditions are inconsistent with the Game Terms, the Game Terms shall prevail.

2) Momentra services

  • Momentra platform: Through the Momentra Platform, a User—applying their knowledge of a given subject and based on publicly available information (including information collated and made available through the Momentra Platform)—can place bids and apply this knowledge on the other exams, tests and any other academic platform across India.

3) Participation on Momentra Platform

  • As part of its services, Momentra shall, via the Momentra Platform, make available questions relating to the particular subject of a specified topic and information collated from publicly available sources like books of NCERT and other books of same subjects related to that subject and topic and/or the ability for Users to contribute their own knowledge, information and related academic expertise.
  • Depending upon the potential outcome for each specified question, the time period associated with that question, the number of answers submitted, and any other factors that Momentra may deem relevant at its sole discretion, Users may be allowed to edit their answers and/or submit answer to a given question.
  • The Momentra Platform shall, on a best-efforts basis, attempt to match a User’s answer to a specified question with a complementary answer from another User. Once a complementary answer is found and a match is made, neither of the Users shall be allowed to withdraw their submitted answer, and the settlement between the Users shall be determined on based of the total time taken by users, time taken by user on that particular question, total credibility score, credibility score of that particular question and age of the users.
  • Momentra reserves the right to abandon any specific question or set of questions, or to modify the deadline for submitting answers to such questions, in circumstances that are uncertain or beyond its reasonable control. Momentra will make reasonable efforts to notify Users of such changes through appropriate communication channels, including Momentra Application (App) but not limited to email, SMS, or WhatsApp messages, in order to keep Users duly informed.
  • Answering certain specified questions may be subject to additional rules, which Momentra shall communicate to the User(s) prior to submission. Unless explicitly stated otherwise, such rules shall be deemed to supplement and not override these Terms and Conditions.
  • To participate, a User must pay an amount. A winning user is determined based on the actual outcome/answers of the questions. A User’s answer shall be deemed successful if the knowledge or academic vision that formed the basis for the User’s response are met and/or have match the actual result/answer. Conversely, if those parameters are not met and/or have not occurred, the answer shall be deemed unsuccessful.
  • All Users understand and acknowledge that participation on the Momentra Platform, including the submission of answers to specified questions, is based on each User’s individual knowledge analysis and academic vision. While Momentra collates and provides questions and information related to such subjects and topics from publicly available sources and books, Users are encouraged to independently gather, assess, and analyze relevant questions and information before participation.
  • To submit an answers to a specified test, a User must submit funds to their account on the Momentra Platform (“Momentra Account”). Momentra may, at its sole discretion, determine the limits on the amounts that can be added to or held in a User’s account, either in aggregate or in specified tranches. All credits and debits related to submitting test, successful or unsuccessful will be made to or from (as applicable) the User’s Momentra Account.

4) Intellectual property

  • Momentra includes a combination of content collected/collated/analyzed by Momentra, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights (“Intellectual Property Rights”) in all software underlying Momentra and the Momentra Platform and material published on the Momentra Platform, including (but not limited to) software, advertisements, content (whether written, audio and/or visual), photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clippings, animations etc. is owned by Momentra, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Momentra either in whole or in part without express written license from Momentra.
  • Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available via the Momentra Platform (“Users’ Content”). Each User represents and warrants that they own all Intellectual Property Rights in the Users’ Content and that no part of the Users’ Content infringes any third-party rights. Users further confirm and undertake not to display or use the names, logos, marks, labels, trademarks, copyrights, or other intellectual and proprietary rights of any third party on the Momentra Platform. Users agree to indemnify and hold harmless Momentra, its directors, employees, affiliates, and assigns against all costs, damages, losses, and harm, including litigation costs and counsel fees, arising from any third-party claims— including claims of infringement of Intellectual Property Rights—resulting from such display or use of third-party names, logos, marks, labels, trademarks, copyrights, or other intellectual and proprietary rights on the Momentra Platform by the User or through the User’s actions or omissions.
  • Users hereby grant to Momentra and its affiliates, partners, licensors, and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users’ Content for any of the following purposes:
    • Displaying Users’ Content on the Momentra Platform
    • Distributing Users’ Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it, and/or
    • Storing Users’ Content in a remote database accessible by end users, whether for a charge or otherwise
    • This license shall apply to the distribution and storage of Users’ Content in any form, medium, or technology.

All names, logos, marks, labels, trademarks, copyrights, or other intellectual and proprietary rights displayed on the Momentra Platform belonging to any person (including a User), entity, or third party are acknowledged as the proprietary rights of their respective owners. Any claims, controversies, or issues concerning such names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights must be directly addressed to the respective parties, with a copy of such notice sent to Momentra.

5) Third Party Sites, Services and Products

  • Links to other internet sites owned and operated by third parties may be provided via the Momentra Platform. Users’ use of each of those sites is subject to the terms and conditions, if any, specified by the respective third-party sites. Momentra does not exercise control over any internet sites other than the Momentra Platform and cannot be held responsible for any content residing on third-party websites. The inclusion of third-party content or links to third-party internet sites does not constitute an endorsement by Momentra of such websites or their content.
  • Users’ correspondence, transactions, offers, or related activities with third parties—including payment providers and verification service providers—are solely between the User and the respective third party. Users’ interactions, transactions, and use of services or offers provided by such third parties shall be governed by the terms and conditions, policies, and other applicable service terms adopted or implemented by those third parties. The User shall be solely responsible for reviewing and understanding such terms prior to transacting with or availing services or offers from any third party. The User agrees that Momentra shall not be held responsible or liable
    for any loss or damage incurred as a result of any such transactions or interactions with third parties. Any questions, complaints, or claims related to third-party products or services should be directed to the respective vendor or service provider.
  • The Momentra Platform contains content that is created by Momentra as well as content provided by third parties. Momentra does not guarantee the accuracy, integrity, or quality of the content provided by third parties, and such content may not be relied upon by Users in utilizing the Momentra Services provided on the Momentra Platform.

6) Privacy Policy

  • All information collected from Users, including registration details and payment information, is subject to Momentra’s Privacy Policy, which is available at [Privacy Policy].

7) User Conduct

  • Users agree to abide by these Terms and Conditions and all other rules, regulations, and terms of use of the Website. In the event a User does not comply with these Terms and Conditions and all other applicable rules, regulations, and terms of use, Momentra may, at its sole and absolute discretion, take necessary remedial action, including but not limited to:
    • Restricting, suspending, or terminating the User’s access to all or any part of Momentra Services
    • Deactivating or deleting the User’s account and all related information and files associated with the account
    • Any amount remaining unused in the User’s Momentra Account on the date of deactivation or deletion shall be transferred to the User’s bank account on record with Momentra, subject to any applicable processing fees as set out herein.
  • Users agree to provide true, accurate, current, and complete information at the time of registration and at all other times as required by Momentra. Users further agree to update and maintain the accuracy of their registration information as and when changes occur.
  • A User shall not register or operate more than one User account with Momentra.
  • Each User specifically consents to receiving communications from Momentra via email, SMS messages, and WhatsApp messages.
  • Users agree to ensure that they can receive all communication from Momentra via emails, SMSs, or WhatsApp messages. Momentra shall not be held liable if any email, SMS, or WhatsApp message remains unread by a User as a result of such communication being delivered to the User’s junk or spam folder.
  • Users agree to exit or log out of their accounts at the end of each session. Momentra shall not be responsible for any loss or damage that may result from the User’s failure to comply with this requirement.
  • Users agree not to use cheats, exploits, automation tools, software, bots, hacks, or any unauthorized third-party software designed to modify or interfere with Momentra Services and/or the Momentra user experience, or to assist in any such activity.
  • Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying Momentra or Momentra’s Services.
  • Users agree that without Momentra’s express written consent, they shall not modify or cause to be modified any files or software that are part of Momentra’s Services.
  • Users agree not to disrupt, overburden, or assist in the disruption or overburdening of (a) any computer or server used to offer or support Momentra or Momentra’s Services (each a “Server”); or (b) the enjoyment of Momentra Services by any other User or person.
  • Users agree not to initiate, assist, or become involved in any type of attack, including but not limited to the distribution of viruses, denial of service attacks, or any other attempts to disrupt Momentra Services or any other person’s use or enjoyment of Momentra Services.
  • Users shall not attempt to gain unauthorized access to User accounts, Servers, or networks connected to Momentra Services by any means other than the User interface provided by Momentra, including but not limited to circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify any security measures, technology, device, or software that underlies or is part of Momentra Services.
  • User shall not publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
  • Without limiting the foregoing, Users agree not to use Momentra for any of the following:
    • To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory, or abusive action or communication.
    • To harass, stalk, threaten, or otherwise violate any legal rights of other individuals.
    • To publish, post, upload, e-mail, distribute, or disseminate (collectively, “Transmit”) any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content.
    • To transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person’s computer, Momentra, any software, hardware, or telecommunications equipment.
    • To advertise, offer, or sell any goods or services for any commercial purpose on Momentra without the express written consent of Momentra.
    • To download any file, recompile or disassemble, or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner.
    • To falsify or delete any author attributions, legal or other proper notices, or proprietary designations or labels of the origin or the source of software or other material.
    • To restrict or inhibit any other user from using and enjoying any public area within our sites.
    • To collect or store personal information about other Users.
    • To interfere with or disrupt Momentra and/or the Momentra Platform, Momentra servers, or Momentra networks.
    • To impersonate any person or entity, including, but not limited to, a representative of Momentra, or falsely state or otherwise misrepresent User’s affiliation with a person or entity.
    • To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Momentra or to manipulate User’s presence on Momentra.
    • To take any action that imposes an unreasonably or disproportionately large load on Momentra’s infrastructure.
    • To engage in any illegal activities.
    • To engage in any action that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, public order, causes incitement to the commission of any cognizable offence, prevents investigation of any offence, or is insulting to other nations.
  • If a User chooses a username that, in Momentra’s considered opinion, is obscene, indecent, abusive, or likely to subject Momentra to public disparagement or scorn, or a name that includes official team/league/franchise names and/or the name of any sporting personality, Momentra reserves the right—without prior notice to the User—to restrict the usage of such names, change the username and inform the User, delete such username and related posts from the Momentra Platform, deny the User access to Momentra, or apply any combination of these actions, at its sole discretion.
  • Unauthorized access to the Momentra Platform constitutes a breach of these Terms and Conditions and a violation of the law. Users agree not to access the Momentra Platform by any means other than through the interface provided by Momentra for the purpose of accessing the platform. Users further agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of the site, except for those automated means that have been expressly approved by Momentra in advance and in writing.
  • Use of the Momentra Platform is subject to existing laws and legal processes. Nothing contained in these Terms and Conditions shall limit Momentra’s right to comply with governmental, court, or law enforcement requests or requirements relating to Users’ use of Momentra.
  • There is no age limit and attempt limit on Momentra platform. All individuals seeking to become Users of Momentra must accurately disclose their age and all the other crucial information at the time of accessing the platform. If any individual provides a false age declaration and any other false information, Momentra shall not be held liable. Such a person shall forfeit all rights associated with their Momentra Account, and shall indemnify and hold harmless Momentra, its directors, officers, employees, agents, and affiliates from any and all losses arising from such misrepresentation. In the event that the person making the false declaration of age and any other information, the legal guardians of such person shall indemnify and hold harmless Momentra, its directors, officers, employees, agents, and affiliates from any and all losses incurred as a result of the false declaration.
  • Momentra shall not be held responsible for any content contributed by Users on the Momentra Platform.

8) Eligibility

  • The Momentra Platform is open for all age users, there is NO age limit on Momentra platform.
  • There is NO attempt limit on Momentra platform.
  • The Momentra Platform is open only to persons who are currently residing in India.
  • Persons who wish to participate must have a valid phone number.
  • Momentra may, upon receipt of relevant information, bar a person from participation and/or from withdrawing amounts from their Momentra Account if it is found that such person possesses insider knowledge or cheating material/method of certain specified questions on which they have submitted or are submitting answers.
  • Only those participants who have successfully registered on the Momentra Platform shall be eligible to participate in tests.
  • If a person succeeds in test and eligible for rewards mention then they should NOT further participate in another test until further notice.

9) Paper/Test pattern

  • The test will be MCQ-based. There will be 40 questions in total, out of which students are required to attempt any 30 questions as per their preference.
  • Each correct answer will carry +3 marks, while each incorrect answer will result in a -1 mark penalty.
  • The syllabus includes Mathematics, Science (Physics, Chemistry, and Biology), Reasoning, Problem-Solving Questions, General Knowledge (covering History, Sociology, Politics & Economics), and Current Affairs from classes 9th to 12th. For more detailed information, please refer to the (ʻʻsyllabusˮ) section available on the website and app.
  • Types of questions:
    • Normal MCQs (single-word questions with 4–5 options)
    • Statement-based questions
    • Assertion and Reason-based questions
    • Match-the-following questions
    • True/False-based questions
    • Diagram-based questions
    • Graph-based questions
    • Pattern based questions
  • Some questions may have more than four options, including up to 5–6 options.
  • There will be no subject-wise segregation. All questions will appear consecutively in a mixed format.
  • Number of questions subject wise.
    • Math = 8 – 9 questions.
    • Science = physics – 6 questions, chemistry – 6 questions, biology – 6 questions.
    • Reasoning/amplitude/problem solving = 8 – 9 questions.
    • Current affairs and general knowledge = 4 – 6 questions.
  • The number of questions mention here will be strictly followed in question papers in tests.

10) Payment Terms for Momentra Platform

  • In respect of any test submitted via the Momentra Platform, Users agree to be bound by the following payment terms:
    • To be eligible for any financial or monetary benefit, a candidate must secure at least 80% of the total marks.
    • Once a candidate achieves the qualifying marks, they will be notified by the Momentra team via email and phone call. All further information and procedural details will be communicated through the same channels.
    • In case of a tie, or if multiple candidates secure the same marks, the ranking will be determined based on the following criteria in order:Credibility score of the candidate > Average time taken > Age of the candidate.

11) Dispute and Dispute Resolution

  • If any dispute arises out of, or in connection with, the services provided by Momentra via the Momentra Platform, including the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) or Momentra (a “Dispute”), the disputing parties shall endeavor to resolve such Dispute amicably. An attempt to achieve an amicable settlement shall be deemed to have failed if the Dispute is not resolved within thirty (30) days from the date it is communicated in writing by either party.
  • If the parties are unable to amicably settle the Dispute as mentioned above, any party to the Dispute shall be entitled to serve a notice invoking Arbitration. The Dispute shall be referred to and finally resolved by arbitration. The Arbitration shall be conducted by an Arbitral Tribunal consisting of a sole arbitrator in accordance with the Rules of the Delhi International Arbitration Centre (“DIAC Rules”), which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be New Delhi. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The law governing the arbitration agreement shall be Indian Law
  • Nothing shall preclude any Party from seeking interim or permanent equitable or injunctive relief, or both, from the competent courts at New Delhi, having jurisdiction to grant relief on any Disputes. The pursuit of equitable or injunctive relief shall not be a waiver of the duty of the Parties to pursue any remedy (including for monetary damages) through the arbitration described herein.
  • The arbitration award will be final and binding on the Parties.

12) Release and Limitations of Liability

  • Users shall access the Momentra Services provided via the Momentra Platform voluntarily and at their own risk. Momentra shall, under no circumstances, be held responsible or liable for any loss or damage sustained by Users or any other person or entity during their use of or access to the Momentra Platform.
  • By accessing the Momentra Platform and the Momentra Services provided therein, Users hereby release and agree to indemnify Momentra, and/or any of its directors, employees, partners, associates, and licensors, from and against all liability, cost, loss, or expense arising out of their access to the Momentra Platform and the Momentra Services, including (but not limited to) personal injury and damage to property—whether direct, indirect, consequential, foreseeable, due to any negligent act or omission on their part, or otherwise.
  • Momentra accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties, in relation to the data/information collated and published on the Momentra Platform.
  • Users shall be solely responsible for any consequences that may arise due to their access of Momentra Services by engaging in any illegal activity or by failing to comply with these Terms and Conditions and other applicable rules and regulations related to Momentra Services, including the submission of incorrect personal information. Users also agree to indemnify Momentra and its respective officers, directors, employees, and agents in the event of such violations (including, without limitation, attorney fees, legal costs, etc.) on a full indemnity basis for any loss or damage suffered by Momentra as a result of such actions by the Users.
  • Users shall indemnify, defend, and hold Momentra harmless from any claims made by any third party, entity, or organization arising from or related to such User’s engagement with the Momentra Platform. Under no circumstances shall Momentra be liable to any User for any acts or omissions arising out of or related to the User’s engagement with the Momentra Platform.
  • In consideration of Momentra allowing Users to access the Momentra Platform, to the maximum extent permitted by law, Users waive and release any and all rights, claims, actions, or causes of action (present or future) that they may have against Momentra, its agents, directors, officers, business associates, affiliates, sponsors, employees, or representatives for any injuries, accidents, or mishaps (whether known or unknown, anticipated or unanticipated) arising out of the provision or use of Momentra Services.

13) Disclaimers

  • To the extent permitted under law, neither Momentra nor its parent/holding Company, subsidiaries, affiliates, directors, officers, professional advisors, or employees shall be held responsible for the deletion, failure to store, misdelivery, or untimely delivery of any information or material.
  • To the extent permitted under law, Momentra shall not be held responsible for any harm resulting from downloading or accessing any information or material, or from the quality of servers, products, Momentra Services, or websites.
  • Any material accessed, downloaded, or otherwise obtained through the Momentra Platform is done at the User’s own discretion, competence, acceptance, and risk. The User shall be solely responsible for any potential damage to their device or loss of data resulting from such downloads.
  • Momentra shall make its best endeavours to ensure that the Momentra Platform is error-free and secure. However, neither Momentra nor any of its partners, licensors, or associates makes any warranty that:
    • The Momentra Platform will meet Users’ requirements;
    • The Momentra Platform will be uninterrupted, timely, secure, or error-free;
    • The results obtained from the use of the Momentra Platform will be accurate or reliable; and
    • The quality of any products, services, information, or other material obtained through the Momentra Platform will meet Users’ expectations.
  • In case Momentra discovers any error, it reserves the right (exercisable at its sole discretion) to rectify the error in such manner as it deems appropriate, including through a set-off of the erroneous payment from amounts due to the User or by deducting the amount from the User’s account. Upon exercising any such remedy, Momentra shall notify the User of the error and the corrective action taken.
  • To the extent permitted under law, neither Momentra nor its partners, licensors, or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of, or inability to use, the Momentra Platform, even if Momentra has been advised of the possibility of such damages.
  • Any Momentra Services being hosted or provided, or intended to be hosted on the Momentra Platform and requiring specific permission or authority from any statutory authority, or from any state or the central government, or from the board of directors, shall be deemed cancelled or terminated if such permission or authority is not obtained or is denied, either before or after the relevant Momentra Services are made available.
  • Any Momentra Services being hosted or provided, or intended to be hosted on the Momentra Platform and requiring specific permission or authority from any statutory authority, or from any state or the central government, or from the board of directors, shall be deemed cancelled or terminated if such permission or authority is not obtained or is denied, either before or after the relevant Momentra Services are made available.
  • To the extent permitted under law, in the event of suspension or closure of any Momentra Services, Users shall not be entitled to make any demands or claims of any nature whatsoever.

14) Grievance Redressal Mechanism

  • In case a User has any complaints or grievances pertaining to (i) any Content that the User believes violates these Terms (other than an infringement of Intellectual Property Rights), (ii) the User’s access to the Momentra Platform, or (iii) any Content which the User believes is, prima facie, obscene, defamatory towards the complainant or any person on whose behalf such User is making the complaint, or involves impersonation in electronic form, including artificially morphed images of such individual, the User may report the same by writing to: grievanceofficer@momentra.in
  • In the complaint or grievance, the User shall include the following information:
    • Name and contact details: Full name, address, contact number, and email address.
    • Relationship to the subject matter of the complaint: Whether the User is the complainant or is acting on behalf of an affected individual.
    • Details of the aggrieved person: The name and age of the person aggrieved or affected by the subject matter of the complaint, in case the User is acting on their behalf. The User must also include a statement confirming that they are authorized to act on behalf of such person and to provide that individual’s personal information to Momentra in relation to the complaint or grievance.
    • Description of the complaint or grievance: A clear and specific identification of the Content related to the complaint or grievance.
    • Good faith statement: A declaration that the User believes, in good faith, that the identified Content violates these Terms and Conditions.
    • Accuracy statement: A declaration that the information provided in the complaint or grievance is true and accurate to the best of the User’s knowledge.
  • Momentra respects the Intellectual Property Rights of others. All names, logos, marks, labels, trademarks, copyrights, or other intellectual and proprietary rights displayed on the Momentra Platform are acknowledged as proprietary to their respective owners (including Users, entities, or third parties).If any User identifies a potential infringement of intellectual property on the Momentra Platform, they are requested to send a written notice or intimation containing the following information:
    • Clear identification of the copyrighted work that is allegedly being infringed.
    • Clear identification of the infringing material appearing on the Momentra Platform.
    • Contact details of the complainant: full name, address, email address, and phone number.
    • Good faith statement: A declaration by the User that they believe, in good faith, that the disputed use of the copyrighted material on the Momentra Platform is not authorized by the copyright owner, its agent, or the law.
    • Accuracy and authorization statement: A statement confirming that the information provided is accurate, and that the signatory is authorized to act on behalf of the owner of the exclusive copyright right that is allegedly infringed.
    • Signature of the User or the User’s authorized agent.

  • Upon receiving such a complaint, grievance, or notice, Momentra reserves the right to investigate and take any action it deems appropriate in its sole discretion. Momentra may contact the User for further clarification, additional information, or assistance in the course of its investigation. The User acknowledges and agrees that timely cooperation will aid in the effective resolution of the matter.

    The Grievance Officer identified above pursuant to the provisions of applicable laws including but not limited to the Information Technology Act, 2000 and the Consumer Protection Act, 2019, and the Rules enacted under those laws. The Company reserves the right to replace the Grievance Redressal Officer at its discretion through publication of the name and title of such replacement on the website, which replacement shall come into effect immediately upon publication.
